Legal Question in Business Law in Illinois

opening a new Physical Therapy clinic

I am a PT that worked for 14 years in an outpatient clinic. 3 years ago I went back to school for chiropractic. I have now 11/2 years left until graduation. I have this great opportunity to open an PT clinic in a building owned by an MD. I have my own corporation: Optimal Heath. I want to open this clinic with the doctor (general physician ) being a minority shareholder in my corporation. She will contribue the rent and some initial investment. Is this legally fiseable.

Re: opening a new Physical Therapy clinic

Yes, it is feasible if you amend your Articles of Incorporation and file with the Secretary of State of Illinois. You will need to accurately describe both the initial and ongoing monetary contributions of the doctor, and what penalties attached if any or all of those contributions are not made on time. What city are you in for this office? Do you need an attorney? This answer does not constitute legal advice because you are not as yet my client.

There may or may not be some concerns about prohibited self-referrals, if your physician participates in Medicare or Medicaid. It will take a bit of research for this one. I'd recommend further discussing this matter with an attorney.
