I ordered something to a local dealer and I was told that if I wanted to refund my deposit I had to pay a restocking fee. I have been waiting over a month for this to come in, how long do I have to wait before they have to give me back my deposit without restocking fee? Is there any way to get back my deposit without a restocking fee?

As the merchant. If these policies were NOT posted plainly when you put the deposit down, the merchant may be engaging in deceptive practices that you may be able to report to the police and get your deposit back without the restocking fee. If these policies ARE posted, you'll have to read them. PS restocking fees usually apply to goods that are IN the store and you return them, or the merchant must purchase to have shipped to the store for you and which you later reject because you just don't like the goods. If the goods come in but are NOT what you ordered, then there should be no restocking charge due to a mistake. There may be other situations depending on the facts.
