Legal Question in Business Law in Illinois
Put $1000 down on a motorcycle at a store yesterday. Received receipt and saw that the policy states "No cash refunds only store credit". I don't want the item from the store nor do I want anything else from the store. The balance that I owe on the layaway plan is approximately $4700.00. The item still needs to be ordered, also.
I want to ask for the $1000 back but I'm afraid that they'll tell me -- "STORE CREDIT ONLY". Is it possible to get my money back?

My advice: insist on the return of your cash payment. Such policies on "store credit only" should apply only to final purchases which are returned. You should read any purchase agreement or contract you signed, but, based on your information, it doesn't appear that your purchase was complete or that the motorcycle was delivered. Usually, such purchaser has at least three days to cancel the purchase.
As a Franchise Attorney I agree partially with the other attorney answer. Certainly is a good idea to promptly cancel the transaction before the motorcycle is ordered and see what their response is. There is no automatic 3-day right to cancel the purchase however, unless this is specified in your contract. Consult with a good business or franchise attorney in your area for specific advice.
