Legal Question in Business Law in Illinois
My question is in regards to identity theft. Are there any legal ramifications to a business that failed to verify id, and ultimately resutled in using another persons identity illegally. I.e. I had my identity stolen. The party/parties in question tried to sign up a wireless account at two locations before becoming successfull at the third. The first two locations were approved, but in the pending status(physical id). The third location approved and most likely signed the account up without it. It was a major retailer. Do I have any recouse against this company? Thanks

Hello. I can understand your frustration here. If the company used your information in connection with this unauthorized account, it could be held liable, in my opinion. However, this is a tricky situation. I think the degree to which the company will be liable will depend upon the amount of damages sustained by you, and whether it can be proven in a court of law that the company knew or should have known that the information provided by this unauthorized person was stolen. You should consult an attorney regarding this matter as soon as possible. My comments are based upon the limited information that I have read in your posting.
