Legal Question in Business Law in Illinois

I recently was laid off from my job of 11 years. my employer is in some financial trouble and is being sued. he informed myself and a few other employees that we would not get our paychecks for 2 weeks, and that after that time we would be given our money. we trusted him and took him at his word. we all showed up and did our jobs as usual. at the end of the two weeks still no checks, when we approched him about this he said that he was waiting on the outcome of a hearing and that we had to be patient. after a month with out our paychecks he laid us off. is he liable for our back pay, or did we just get burnt big time?

As a Franchise Attorney I can say this. Employers are required to pay for the time employees work. Being laid off doesn't mean the employer is excused from paying back wages owed. If you haven't been paid, contact your local employment development or labor department. They will investigate and take appropriate action. Consult with a good business or franchise attorney in your area for specific advice.
