Legal Question in Business Law in Illinois

required medical exam

Is an employer required to pay for a medical exam that they require an employee to have. Example. A fire Dept has a yearly physical agility test. If the firefighter does not pass the test, they are required to have a doctors note before being able to return to active duty. The Fire dept requires the test and doctors exam but refuses to pay for it.

Re: required medical exam

Whether the fire department is required to pay

for the physical exam and the doctor's visit, if

you don't pass, could depend on what your union

contract includes, assuming there is a union. Or

it could depend on what is specified in an existing contract betweeen the municipality where

you work and the fire department. Also, whether

the fire department consists of volunteer firefighters may have some bearing on the situation. For example, volunteer fire fighters

would not have as strong a case for these costs

to be covered compared to full-time fire fighters.

I will be happy to answer any additional questions

that you might have.
