The other attorney is on point here, but you also need to consider some other important issues. Did you take, or are you using, any proprietary information belonging to your former employer? Things like customer lists, proprietary business methods, etc. These kinds of cases are highly fact dependent so you should consult an attorney. Consult with an attorney in your area for specifics.
