Village withholding applied for liquor licence in order to change hours.
My question involves dealing with the village board, and the mayor, which is also the village liquor comissioner. When I tried to apply for my liquor licence, I called the mayor and he said, I had to go to the meeting, and he could take care of it all at the next open public town meeting. So instead, when we went to the meeting, he just handed me the application and sent me on my way. When I left he held a emergency meeting to change the village ordinence to lower the liquor licence hours lower than all my surrounding competiton. Every prior licence holder in the town never had to attend the meeting, they just applied and it was issued. I know there meeting was illegal because no agenda was posted 48 hours prior to the public. So now my application had been in for 2 weeks and the mayor will not issue my licence. Don't they have to have just cause not to issue a licence if one is availible? Now from all this stalling I have a projected loss of $30,000 just this month and I still can't open. I am curious if there is anything legally I can do to get the origional licence, and something for my back losses.

Hello. In Illinois there is the open meetings
act which prohibits entities such as village
boards from meeting without notice or allowing
the public to attend. Of course the license
situation is political, but your best bet is
to investigate wheter you have a lawsuit against
the village for violating to open meetings act.
