Legal Question in Civil Rights Law in Illinois

I was arrested due to computer error

After missing a traffic court date, a warrent was put out for me. I called the following Monday and asked what I could do and was told to file motion to quash warrent.

I went to court 3 days later and the Judge vacated the warrent, and took care of the traffic case.

One month later as I was in a different county's traffic courtroom, I was told that there was a warrent for my arrest and was led off to county jail for the whole day.

After getting released, I called the county where the computer error was made and in one minute they told me that the clerk made a mistake.

Do I have legal recourse for being held all day, being humiliated, and degraded in jail, and missing out on my day's pay at work, not to mention putting me in a negative light at my job??

Re: I was arrested due to computer error

Yes, in my opinion you do have a basis for a

lawsuit against the County. Your arrest was

unlawful. You do have a statute of limitations

period, but assuming this happened to you recently, you will not have to worry. This matter should be filed in state court and the statute of limitations is two years. Will be happy to answer any additional questions you might have.
