Legal Question in Civil Rights Law in Illinois

I am currently experiencing chargeback fraud through paypal. I sold an item on Ebay and after 180+ days, the buyer opened a chargeback case through her credit card company. She told her credit card company that the item was not as decribed or damaged, which is comepletly not true. I have evidence to prove this. Now my paypal account is in negative status because of the hold on the money. What can I do?

Fight the accusation. Paypal has internal dispute resolution but may not rule in your favor. If they believe the buyer, you may be stuck with their arbitration requirements. Look into their dispute resolution procedures first. If you're thinking of suing remember Paypal is really a "clearing house" and "middleman" and if the buyer is not in your jurisdiction you may have to sue in the buyer's jurisdiction and if Paypal terms and conditions obligate the parties to arbitration, your case could be deferred and you could be required to arbitrate long distance. Depending on how much is involved it may be worthwhile for you to take this one "on the chin", refund the purchase price and demand the product back, and attempt to resell it.
