Legal Question in Civil Rights Law in Illinois

false order of protection filed

I have had an ex repeatedly file false OOP cases against me. The first time (2005 my atty did not show during the third court date and I proceeded without him) and the judge granted it. Now she has done it again (2008) in spite of the fact we have had no contact outside of the court room. I won the second filing and she immediately filed 3 weeks later. We won the third case as well and her allegation that I showed up at her job harassing her can be proved since her employer (when contacted by my atty said she has not worked there in over 8 months). What recourse do I have to recover my legal expenses?

Re: false order of protection filed

Talk to your attorney about bringing sanctions against your ex and/or her attorney for bringing repeated motions for the purpose of harassment and annoyance.

With that said. If your ex is 2/4, that motion will likely fail. Its hard to say a successful motion deserves sanctions...
