Legal Question in Civil Rights Law in Illinois

harassment/hate crimes

For the past 3 years our teenage daughter has suffered emotionally at the hands of her classmates.

The final outcome was our taking her out of the school system because of suicidal tendancies related to her treatment at school.

What is our rights to assure other students do not become victims of their vindictiveness?

Re: harassment/hate crimes

Your daughter (or you on her behalf, if she is a minor) may have a claim against the wrongdoers (or possibly the school district) for the tortious conduct of the perpetrators. The claim may be in the nature of intentional infliction of emtional distress. Of course, a review of the facts would be necessary before determining the merits of any such claim. It is less clear that you have rights to protect the interests of other students, but again this can only be determined after thorough consideration of the circumstances.
