Legal Question in Civil Rights Law in Illinois
how long does the have to formally charge and set bond on a subject
my son was arressted on dec.22,2006.they never read him his rights .they handcuffed him and searched him and his car without asking first .after putting him in jail on friday , they said they wouldn't set bond till the next tues. after christmas. on that day , i went to the courthouse at 9;00am to be told a judge wouldn't be in court till thurs. they went ahead set bond on him tues26th at 2:00pm.
i thought they had 72 hours in order to charge him and set bond on him ? am i wrong ?he was arressted for tresspassing, break in entry. and possession of meth. he went to a public bathroom in a park .but it was a little passed 10;00pm which it is posted park closes at 10;00pm.
he picked the lock on the bathroom door cause he had to use it . his bond was set at 2,000 cash.

Hello and Happy New Year. Clearly
your son should not have been held
so long, without being charged. He
needs a lawyer and he should not make
any statements to the police or the
State's Attorney's office. I will be
happy to discuss this with you further and in more detail.
