Hello. This is a very serious matter. Of course the police officer

can be prosecuted for this illegal act and he can be sued. Usually, a federal lawsuit must be filed within 1 year of the occurrence and is known as a claim under 42 U.S.C. Section 1983. However, if this suit is brought in State court I believe that you have 2 years to bring the lawsuit.
