i asked someone not to email me but they keep doing it, can non-commercial anti-spam laws be used to sue

According to the FCC web site, the federal CAN-SPAM Act only applies to commercial messages, those for which the primary purpose is to advertise or promote a commercial product or service. I am unfamiliar with non-commercial anti-spam laws. Can you just go to your Internet provider's mail site and mark this sender as "spam," thereby blocking further messages from that sender?
