Who has the power to set up and configure the Federal Courts?

The United States Supreme Court is "set-up," if you will, in the Constitution. All lower courts are "set-up" the same way as any other statute, by passage through both houses of Congress (the House of Representatives and the Senate) with approval by the President (or an override of his veto).
