Legal Question in Constitutional Law in Illinois

What is the legal argument of the FCC not granting licenses to operate low power fm transmitters(LPFM) in a local community where the local radio stations do not meet the needs of the people? Isn�t the FCC denying my first amendments rights to freedom of speech as an American citizen? They only grant licenses to transmitters of 100watts or more thus radio does not actually serve the local community interest. I want to run a 20 to 30 watt community LPFM transmitter, however, if I do so I am breaking the law according the FCC thus the FCC disregarding the constitution. Where would I stand if I �illegally� operate a Small Local Programming Oriented Radio Station?
