Legal Question in Construction Law in Illinois

My husband and I bought new construction 2 yrs ago. When we did our final walk through our tile was cracked in the front foyer which was replaced. We had it replaced 4 times. Well it cracked again and we decided to pull up the carpet to see if it was the concrete that might be causing the problem. Well sure enough we have a huge crack in our slab that is about 1inch wide and it runs from our front door to our second den room. Our 2nd bdrm as well has a 1 inch crach and it runs from the window to the closet. We noticed that one side of the concrete is higher which to use indicates that our slab is sinking. We also noticed in the 2nd bedroom that they tried to reseal the crack before we moved into the home. I was wondering what approch should I take with this and is this something I should get a lawyer for?

Usually something like this would be covered under the seller's warranties in a standard new construction sale. If the seller tried to repair the crack, then they knew about the problem and should have disclosed it to you. You want to move fairly quickly to make sure there are no statute of limitations problems, but it is probably worth talking to an attorney to figure out your next step.
