Legal Question in Construction Law in Illinois
Bad Construction Job..
We had a basement poured almost 4 years ago. The manufactured owner subcontracted the job. The job was a diaster. So we are sueing and after 3 1/2 years of this they now want to settle stating they do not have defense. So we visited our Attorney who in turn said we have to settle for less because that's how it works. He suggested we take over a $20,000 loss and that truly is still not even close in what cost we have incured through this time lapse. So what do we tell our Attorney who really hasn't been good to us from the start that his number would keep us from ever starting over. Which by the way when this was started we we $-0- in debt. And now we are in over close to $80,000??? What offer would be fair to us. This manufactured person who we also ordered a home from and paid a deposit, has since sold our home??? And he kept our 10% on the home and 1/2 down for the basement. This has been a nightmare not only from the manufactured place but also represented badly by our Attorney. Who by way got paid up front also! Can you help us decide how to offer a settlement. Also a court date if they do turn now the offer of Oct 29, 2007

You should consult with an attorney in person or at least on the phone. Even though you did a good job of explaining the situation, an attorney will have many other questions before he/she can give you proper advice.
Be advised that the attorney cannot make the decision to accept or reject a settlement offer. That decision is for the client to make.
