Faulty Materials
Last year I hired my a friend, a union cement finisher, to install a new sidewalk and driveway for me. He and his crew did very good work and my wife was very pleased with the results. However, this spring we noticed that the cement was flaking and chiping on the surface. I asked my friend about this and he was very suprised that it happened. He inquired with the company that supplied the cement,they agreed that the problem was with the cement,not the workmanship.The company has agreed to replace the cement, but gave no indication they would pay for the labor involved to perform the work.
Question. Should the cement company also be responsible for time, material, and labor cost involved in replacing the cement?

It appears that the cement manufacturer would be liable for the costs of repair to the driveway. Costs of repair would include labor, supplies, etc. Most manufacturers offer a warranty on products which are deemed to be defective. If the manufacturer provided a warranty, they are obligated in repairing the work caused by the defective materials. Please contact me with any questions related to this.
