Legal Question in Construction Law in Illinois

I hired an Electrician to redo all electric work on a hse I purchased to rehab. I signed a contract in August 2009 & paid 50% up front. He verbally said the work would be done in 2 to 3 weeks since all the walls are exposed. In October 2009 I paid him another 25% because he promised to complete the job. It is now Feb 2010 he still has not completed the job & I am losing money because I have to pay rent since I cannot live there without electric. What can I do?

The first step is to send him a demand letter including a specific date for the work to be completed. Inform him that if he fails to complete the work by that date he will be considered in breach of the contract and subject to legal action. If he does not complete the work, you will have an action against him for breach of contract in court.

I would advise speaking with an attorney to review the contract and discuss the specifics of your legal options. Often, having an attorney draft a demand letter is more effective than doing it yourself. After all, you have already had difficulty dealing with the electrician. He may view a letter from your attorney as a sign that you are serious about the matter.
