Legal Question in Construction Law in Illinois
marble floor builder layed does not hold grout
we had a builder build a masterbath addition. We supplied the 18X18 marble tile for the floor and wall. Floor has radient heat. 6 months later the grout sank between the marble in the walking area. They regrouted same thing happened within 2 weeks.Marble had a mesh back. Builder claims the backing heats up and it seperates from the tile, causing the marble tiles to become loose. No other tile people or the nationwide company we got it from ever heard of this. Builder wants us to pay for new marble, he will install. We paid for it once do we now have to pay again? We had many problems with the lack of knowledge this builder had, but were pleasent, resolved the issues and paid for all upgrades with out question, it was an $100,000.++ addition. What is our recourse?

Re: marble floor builder layed does not hold grout
Hello. In my opinion you should consider filing
a lawsuit against the builder. It appears that
the builder may have been negligent while installing the material since you say that the
manufacturer never heard of this problem happening before. You payed alot of money, without question, but you are not stuck with having to swallow this problem, without a fight.
However, time is of the essence. The longer you
wait, the weaker your claim may appear. I will
be happy to answer any additional questions you
may have.
