Legal Question in Consumer Law in Illinois

Are advertisements in e-mails binding?

I joined a workout group and got a t-shirt upon joining the first session. Halfway through the first session I recieved and e-mail containing the following statement:

''By the way, if you decide to join us for another session, you get another FREE T-SHIRT to supplement the one you got when you first signed up.''

I signed up for the second session and then was told that they don't give away t-shirts for the second session any more. Am I due a t-shirt?

If you were promised a second t-shirt and, in reliance on that promise, signed up for another session, you are legally entitled to receive that t-shirt. The fact that the offer came in the form of an e-mail is not directly relevant.

My firm concentrates its practice on consumer fraud cases (with an emphasis on class actions). I'd be more than happy to discuss this with you further, at no charge. My number is 312-913-9400.
