Air Conditioner Repair
Question: I recently contacted an air conditioning repair service to see if they could repair my system. The person answering the phone said they were busy, but he may be able to work me in by late afternoon that same day. I told him someone would be at the house all afternoon. My daughter stopped to get lunch a little after 12:00 noon and by the time she arrived home, approximately 12:20 p.m., the air conditioner repairman had already left the house and left a message on the machine that he had found no one there so he was leaving. Now, he has been billing me for a service call and late fees which I have refused to pay since no service was provided and there was no call informing me that he would be at my house earlier than expected. I am now being sued for breach of contract. Since there was no set appointment, no agreement of terms, and no statement as to what might happen if no one was home, am I guilty of breach of contract?

I can't believe they're suing you since the cost of filing the suit and serving you most likely cost them more than the amount they are looking for. Sounds frivolous but would have to see the complaint to give a thorough opinion.
