Legal Question in Consumer Law in Illinois

Breach of Contract w/ Remodeling Contractor

I signed a contract with a contractor to redo my kitchen, lay ceramic tile on my floors, redo my bathroom and lay harwood floors as well. The project was to be completed by the end of February, needless to say it is not done. I gave him $1500 as a deposit for harwood floor materials, $500 to purchase ceramic tiles & tub, as well as $2500 for labor. He has failed to give me the materials I purchased and any money associated with it. He does not return my calls and has scheduled meetings that he cancels at the last minute. There are other issues I am dealing with as well. I've been told that I could either seek an attorney or go to the courthouse and file a petition myself. Is it best to use an attorney or file it on my own? He has also done the same thing to a friend of mine. Would it be best for the both of us to combine our losses? This experience is costing me so much and I feel as if I was taken advantage of, especially since I know the contractor. Any help or advice is appreciated!

Re: Breach of Contract w/ Remodeling Contractor

You can sue him in small claims. Whether it would be better to hire an attorney depends on you. If you have no experience, you may have a difficult time navigating the legal process. It is probably not possible for you to combine your lawsuit with your friend.
