Legal Question in Consumer Law in Illinois

Cancel Contract- Do I have 48 Hours?

My sister just signed a contract to buy a wedding dress and we put down a deposit today. We were told by the sales assoc. that the dress we were looking at was exclusive only to that shop since they had been in business 35 year and they don't make it for any other shops. In addition, they cut out the maker's tags from all dresses so we had no clue who the designer was- except when asked we were told it was an exclusive contract and made in China.

When we got home, we happened to open a wedding magazine and there was the exact same dress. After calling 5 other bridal shops we can get it at all of them for almost 1/2 the price.

We just bought homes and know there is a 48 hr cancel policy. Is the same true with this contract or do we have any legal rights due to being mislead by the associate? The store is closed until Tuesday.

Thank you for your help!!!

Re: Cancel Contract- Do I have 48 Hours?

There is no statutory 48 hour "cancellation policy" in Illinois. Perhaps it is part of the particular contract you signed, but it is not required--and actually would be quite unusual. The same holds for almost any other contract. There are very limited exceptions, for example, when you refinance your residence, or buy something sold door to door. In the case of your dress, while you don't have a 48 hour right to cancel, you may be able to have the contract voided, since you can argue that they committed fraud in their assertions to you.
