Legal Question in Consumer Law in Illinois

Used Car

My son purchased a used car today and is already having trouble with it. Can he return it to the dealership and get his money back?

Thank you,

Re: Used Car

Legally, the dealer is under no obligation to return the money. However, I do not know under what terms the car was sold so it is always best to consult with an attorney in your area.

Re: Used Car

Depending on where the vehicle was purchased, there is no law in IL which will allow you to return the vehicle for a refund, unless the vehicle was purchased from an "off-site" location. If the vehicle was purchased from the dealership, generally there is no way to rescind the contract (absent fraud, duress, coercion, etc.) On a used car, the dealership will typically sell it "as is" therefore it is often recommended that a good check is made of the vehicle, including repair history and CarFax. Perhaps you can go back to the dealership and negotiate a trade for that vehicle.
