Legal Question in Consumer Law in Illinois

Dispute Resolution

I bought furniture, one piece was damaged, merchant attempted to repair/replace, item still damaged, merchant ignored complaints, consumer disputed with credit card, merchant did not respond to dispute, credit card found in favor of consumer, now merchant is threatening collections.

Can the merchant do this?

Re: Dispute Resolution

Yes, they can. Now that the ball is in your court, so to speak, maybe the merchant will be more willing to discuss a proper resolution. Most likely, the items you received had some value, however, the merchant has not received any compensation since the credit card company refunded the money to you. Previously, the merchant was paid in full, and apparently was not interested in discussing repair or replacement with you. Now that you have the furniture and the money, I would urge you to do what is right and try to work out with the merchant a mutually satisfactory resolution. You may need a disinterested third party to assist you, which may end up being a judge. Don't make the same mistake the merchant did by ignoring the credit card company--respond to every correspondence you receive regarding this matter.
