Legal Question in Consumer Law in Illinois
First of all, thank you for offering this service. It really helps us poor people. So here's my issue. In 02 i defaulted on some debt. for the last couple weeks a firm has been calling trying to collect. I been ignoring it due to the 10 yr statute. But they have been persistent so I called back. They claim that the account just went into collections in 14, yet there has been no activity or payments since 02. When i talked too them i denied even having the account and claimed fraud. However. Back around 14 another agency was calling about the same account. At that time I acknowledged the debt thinking the statute had run out. But if it went to coll in 14 why are they just now calling me? The debt was accumulated in Ms and the statute is 7 yr there, but I later moved here. They are using scare tactics to try and get me to settle. Are they bluffing or should I to settle? No reason to settle. Just ignore. You can also tell them to stop contacting you. If they refuse, they are violating collection practices and you will have a claim against them.
If you haven't made a payment in over ten years, the statute has long since run. Tell them if they call you again you are filing suit against them!
