1 Answer from Attorneys
Maybe - oil change place may be liable to you. They may have insurance on these kinds of things. Getting them to admit they screwed up will probably be a problem, and without proof action you take could be viewed as just sour grapes. It may make a difference if you are the kind of person who ever changed his or her own oil, or never did, or went to this place before or regularly went there, or whose family went there. But that's a lot of money. An attorney may be able to help make up the right kind of letter and threaten action. You may have some recourse through the Illinois Attorney General. If this is a national chain oil change operation, you can try going up their corporate ladder. There's always the Better Business Bureau too. Or you may be able to use some pressure on them if they have licenses to be in business - both state and local.
