Legal Question in Consumer Law in Illinois
Who owns an incorrectly shipped package?
I am not really sure on what cattagory of law this would be under. My father recived an item shipped to him with his correct name and address. He opened it and it was something he had never ordered, but he really likes it so he decides to keep it. The item he recicved is of very limited quantity and is sold out. The company that distributed this item has called him saying that is was shipped to him in error and they want it back so they may send it to the person who ordered it, but he does not want to give it back to the company because it was sent to him. What is his legal rights because it was suposed to go to someone else but it was sent directly to him?

Re: Who owns an incorrectly shipped package?
If you dad never ordered the item then it does not belong to him. Did he even pay for the item? I assume not since if he never ordered how could he pay for it?
