Legal Question in Consumer Law in Illinois

Payment for services provided

I had some storm damage done to my house that my insurance company covered. I hired a company to do the work and gave them a down payment from the first of two checks received from my insurance company. Shortly after the work was completed I received the second check from my insurance company. I never heard from the company again and they never asked for the remaining money due to them. This was four months ago. How long do they have to collect this money? Is it possible that my insurance company paid them? What should I do with this money?

Thanks for your help.

Re: Payment for services provided

I assume when you contracted the company to due the repairs that you signed a contract. If that is the case then they have 10 years to collect on the outstanding balance.

I doubt the insurance company paid the company directly, but thats easy to find out--just call the insurance company and see it they did. If there is no pament made to the repair company then you have to decide what to do. Contact them to make payment on the balance or wait for them to contact you.

You know the money is not your money, right? Call the contractor, and call the insurance company. If the contractor wasn't paid, pay them. They did the work, so they deserve to be paid. Maybe the bill they sent you was lost in the mail. If the contractor received a check from the insurance company, send the money back to the insurance company.
