Legal Question in Consumer Law in Illinois

Pet Purchase

Adopted a dog from a ''rescue'' that required a $200 fee (not donation). Lead to believe the dog was gentle, as we noted in the form we filled out.

Our vet of 18 years advised us not to trust it around any children. Dog was agressive to deaf family member.

Vet could not trim her nails w/o sedation. Dog behaved this way to anyone other than wife&I. This was unacceptable. Not our idea of a family pet.

The dog school, recommended by the seller, did not allow the dog to participate, as it was too disruptive. When we told the seller we could not trust the dog, she had her associate pick it up. The associate said, ''Mary Beth (seller) will send you a check''

Later, in a phone call with Mary Beth, she also said she would return our money.

The form we filled out does not address refunds in any way.

But we were told twice, by the rescue people, we would get our money back. The seller implied that we did not know how to handle this dog. We did not bargain for a dog that required professional handlers. This was to be our4th German Shepherd among 3 previously owned shepherd in the past 30 years. Is it legal to sell a dog, take it back,

promise refund & reneg?

It has been 8 weeks, un-answered phone calls and no check.

Re: Pet Purchase

Seeing that 8 weeks have passed it is my opinion that you are not going to get that refund voluntarily. It would appear that you may have to file a law suit to force the refund.

However before you go through the costs of doing that I suggest you send them a certified letter explaining you were promised a refund and that they took the dog back.
