Legal Question in Consumer Law in Illinois

received NSF checks twice from estate sales company

mom passed away suddenly and sons needed to hire a company to sell moms personal property in the house in order to pay balance of her loan, bills, ect.

we signed a contract with this woman and trusted her with the contents of the house.

the contract agreement gives her a commission % of the total sales within the three day sale.

this sale took place in dec 04.

this scumbag sent the first two checks in feb, which both bounced.

we contacted her, her mother, and the police.

i also coctacted our attorney, and a complaint has been written, which i have left numerous messages telling her this.

then, over one month later, two new checks from a different bank were sent, take a guess, both bounced again.

these funds are from my mothers personal property that means the world to us,and this b**** we trusted is trying to screw people that are still mourning the loss of their mother.we were very hesitant trusting such a sale, however, the contract we signed was clear as day.

the monies is double digits and we want to know the best way to approach this to get our money(plus NSF fees, interest, any attorney and court costs) as well as filing charges for theft/conversion,violations of consumer fraud act, deceptive business practice act thanks

If your attorney has already filed a complaint, then it will be up to the court.
