Recently got married in May 2011, hired a photograpgher for my wedding. Took pictures, when he came down to view my pictures under to contact him for about two weeks. Then received a email from him apologizing and provided a link to view my pictures and he told that I have over 1100 pictures, and I replied back that I only see 838. Haven't heard from him until three weeks again asking the status of my pictures and he told be that problems with the links and he said that he would be able to mail me a dvd of my pictures. I told him to just send me the dvd and with rights to my pictures and he said ok. I have called / emailed numerous of time and no response from him. Can I file a lawsuit against him?

Depends on the terms of your agreement. Some parts of your question are unclear. Have you paid him? Did he agree in advance to provide more than 838 images? Can you purchase copies from the link he provided you? Unless there was some agreement to the contrary, I cannot see how you can compel him to give the copyrights for the images to you. Generally, the copyright belongs to the photographer.
