Legal Question in Consumer Law in Illinois

Reimbursment of Money

In August, I bought a car on eBay for 6,500, paid in full through PayPal, I then decided to trade it in for a nicer car I saw at a used car lot, the trade value the car lot gave me was about $6,000. So I gave them a $16,000 cashiers check for the remaining balance of the cars price. Paypal reversed my payment for the first car because they said they had called to verify the amount but couldnt reach me. They sent a repossession company to collect the car; the car lot would not release the car unless I gave them $3,000 cash. I gave them $3,000 cash and they gave the car to the repossession company. A couple weeks later the car lot called and said the cashiers check didnt clear. I returned their car and started to investigate what was happening with the check. My question is: am I entitled to receive that $3,000 cash back?

Re: Reimbursment of Money

Hello. Yes, you are entitled to the

$3000 back immediately. In my opinion

you should not have returned the car,

under those circumstances. Now they have the car and your money. You need to consider filing a lawsuit, or contacting the office of the Illinois Attorney General and making a complaint. I will be happy to advise you further and in more detail.

Re: Reimbursment of Money

That's the least of your worries. Both of those transactions could result in felony charges against you. The first one could involve federal charges.

I guess you could try to get it out of the lot, but you owe them $16,000.00 + $3000.00 on the value of the trade in.
