Legal Question in Consumer Law in Illinois

Tried to return merchandise-no cooperation

I purchased a very expensive hand bag from a store in Illinois over the

internet, when I received the merchandise, it was used. I tried to return the

bag under their terms, and upon my return of the bag, they refused to accept

it. I have a dozen or more emails proving their poor copperation. I live in

california, and they are in illinois, what should I do?

Dispute the charge with your credit card company and tell them to reverse the charge.

See if they do business in Cal. Internet advertising alone won't subject a company to personal jurisdiction of a particular state. Notwithstanding, you can still sue the company here in small claims and see if they will challenge personal jurisdiction. The company could always agree to have the claim adjudicated in Cal. Also, dispute the charge with your credit card company if that's what you used.
