Legal Question in Consumer Law in Illinois
Semi Truck Fraud
On 10/22/2008 i bought a 2004 Freightliner Colombia truck from a dealership. During the sale the owner of the shop, verbally guaranteed that the truck is in an excellent condition and ''is worth every penny''. He also confirmed in front of 3 witnesses that the truck still has 19000 miles of Manufacturer's engine warranty left. That was one of the major reasons i bought the truck because it would give me enough time until i can buy extended warranty on it. He also confirmed that he is convinced that the truck will not give me any problems but in case it does he will be more than glad to fix them for me. On Nov 25, 2008 (only two weeks after the truck got registered and started operating) the problems started. The truck started experiencing sudden engine power loss. After numerous visits to different shops and over $1200 worth of various repairs finally I found out that the engine is completely shot and needs $12700 worth of repairs. Also the Manufacturer's warranty had expired 4 months ago on July 29 2008. The dealer refused to take any responsibility. They have sold me a faulty truck and completely misrepresented the product and its warranty. Do I have any grounds or case to get the truck returned and my money back?

Re: Semi Truck Fraud
Absolutely you have a case. I cannot tell you whether you could get rescission (truck returned and money back) or damages to make repairs, lost income, diminished value, etc. You would need to discuss this directly with an attorney to determine what is most appropriate in your circumstance.
