Legal Question in Consumer Law in Illinois
Theft of Service?
My wife hand makes teddy bears and sells them as part of a party package which also includes her going to the clients homes and entertain the children with party games, make up session, and face painting. She recently did a party and accepted a personal check as payment, several days later her client called her and told her that she was dissatisfied with the party and had stopped payment on her check. The check was returned from our bank NSF. Does this constitute theft of services? What are our legal options?

Re: Theft of Service?
Your wife and her business have a standard breach of contract claim against the customer. Depending on the amount at issue, she would be able to file suit in small claims court or another court that hears matters of relatively significant amounts.
