Legal Question in Consumer Law in Illinois

Warranty Claim

Vinyl siding on our 1 yr old home is deffective. I got 3 estimates from local contractors & all were approximately $3600 for tear down and installation only. Manufacturer will replace material & sent a check for $2890 to cover delivery charges, tear down, reinstallation and disposal. They also included a voucher certificate for needed materials. They suggested that if we couldn't find a local contractor that would do the work for this amount that we contact a certain contractor in New York state! Do we have to settle for this or is there something we can do? We've already paid for this siding and don't feel we should have to pay again. The BBB doesn't even have a listing on the contractor they've recommended.

Re: Warranty Claim

You don't have to do anything - when you say defective, you don't give a clear enough idea on the exact problems. At any rate, warranty law can be tricky. A letter from an attorney might make all the difference but going to court probably wouldn't be worth it.

Re: Warranty Claim

You do not have to settle for the amount sent by the company, but you should not endorse the check, or sign any agreemet of settlement.
