Legal Question in Consumer Law in Illinois

Last year I bought a washer and dryer from an appliance store in the Chicago area. As part of the sale the store was offering a Grocery Rebate Program worth $500.00. Without the $500.00 rebate the washer and dryer were no great bargain, but we bought the appliances because of this promotion offered by the store.

We were supposed to select a grocery store we liked. We needed to spend at least $100.00 per month at the grocery store. Then send the receipts to the Rebate Company and we would receive a $25.00 gift card for the grocery store or a Visa gift card. We did this, but never received anything. The appliance store informed us the Rebate Company went out of business.

My question is, who is legally responsible for the $500.00? Is it the appliance store or the rebate company. I feel it is the Appliance store since that is who we did business with and made the agreement with.

Please advise.

It would depend on the written terms of the rebate agreement, and possibly the advertising material presented in relation to the rebate program.
