Legal Question in Credit and Debt Law in Illinois
I get 20 calls per day and have explained every time that my husband works during the day and isn't home until late in the evening. I'm on social security disability beneifits and their consist calling has increased my depression and panic disorder. These are not my bills and some try to discuss a payment plan. How can I stop this. We don't have the money to pay them at this time since we're stuck with 2 mortage payments. Thank you

Unfortunately debt collectors in Illinois have to go through certain procedures, and one is to contact you -- and this they will do aggressively today. You could tell them you will report them to the Illinois Attorney General or State's Attorney for abusive practices, but some may not care. Ultimately, if this is a land line and you have a cell phone, get rid of the land line or get an answering machine, or get a new phone line that is unpublished, or figure out a way to pay up through some kind of debt relief program. Or just unplug the phone except when you want to make a call.

It depends on whether this is the original creditor or a debt collector. For example, if you have an ABC credit card, ABC is not restricted in contacting you, however, XYZ Debt Collectors, or 123 Attorneys are governed by the Fair Debt Collection Practices Act.
