Legal Question in Credit and Debt Law in Illinois
Added charge billed after collect frieght paid
I ordered driveway gates from NM, manufacturer arranged for collect freight delivery. Local terminal manager called, said charge would be $378.46 for residential delivery the following Monday. I agreed to have four men here to help unload. Driver refuses delivery because ''cable wires too low.'' Says truck and trailer is 13ft. I call cable company, they say lines are 15ft min, city says lines are min 14 ft, trash company says their trucks are 13 -13 1/2 feet. No matter, delivery rescheduled for Wednesday. (I'm out $160 for the four men.)Second truck comes on Wednesday. Unlike original truck, it has a lift. I have my four men (at another $160). I pay driver $378.46 by check and get signed receipt. At upper top, a box is checked that says ''Liftgate.'' There is also a box checked that says ''Residential.'' Two days ago, I received bill from freight company for $378.46. I ignored it. Today I received a notice due of $51 -- they added ''Lift gate delivery.'' This is the first that I was told of any additional charge. I called the local terminal, who told me to call the home office, who told me to call the terminal. Did my payment of $378.46 satisfy my obligations to the freight company?

Re: Added charge billed after collect frieght paid
You had a contract for 378, stuck by it, and they have no grounds to stand on to charge more, ignore their bill, if they try to mess your credit up, you can file up to a hundred word statement in your credit report as to your version of the facts, under Consumer Credit Reporting Law
