Legal Question in Credit and Debt Law in Illinois

I cannot afford an attorney. My income consists of a small pension check from my former husband and social security disability. I am 62 and currently rent a room in a house. I have no assets.

6 years ago I cosigned on a loan for a car for my daughter, who passed away two years ago. Ford credit served me with a judgement for her repossessed auto. Since I had very little income I could not afford payments.

Last week I was notified that Ford Auto took Chase Bank (my cking act.) to court and froze my money. I called all parties to explain my only income is exempt, but I was told the bank did not check the box marked exempt and therefore I am responsible. Do I have recourse except to go to court? I can't afford a lawyer.

You must go to court with copies of your bank statements and copies of your social security and pension statements and fill out the paperwork to claim the exemption. I doubt that your bank even is aware that your income is exempt. Based on what you have written there should be no problem getting the citation discharged based on 100% exempt income.
