Legal Question in Credit and Debt Law in Illinois
I asked GMAC to repossess my car because it would cost $2000 to fix it. I am living on unemployment and cannot afford it, nor to continue making car payments on a car that is not driveable. It is sitting at a car dealer that it was towed to, which is the location given to GMAC/ALLY when I spoke to them. Meanwhile, I bought a very cheap, old used car to get around in. Now, the car dealer sent me a certified letter saying if I don't take the car, they will "dispose of vehicle as allowed by law". I don't have a lot of minutes on my cell phone(my only phone) to keep calling GMAC. What should I do now?

GMAC would have to pay the dealer for any repairs. They do not have to repossess the car. If it not operable, why would they. You are still liable to GMAC for the loan, no matter what, unless you have other defenses..
