Legal Question in Credit and Debt Law in Illinois

How do I avoid legal action from collection agency

If I offer a collection agency a certain amount to satisfy one or more debts and they say the amount I offer is not enough how can I avoid court which then leads to wage garnishment? I am not denying the debt I just can't afford the amount they want me to pay. They even insisted we bring in letters of denial for a loan to prove we could not get one to pay the debt! I want to pay the bills but they insist I pay much more than I can afford. Please advise!

The collection agency is not required to accept less than the full amount of the debt, whether or not you can afford it. One thing you can do is ensure the collection agency has followed the Fair Debt Collection Act to the letter. I have an article on my web site which gives a brief overview. You may want to check it out. It is under News, and then click on the Fair Debt article. www.thomasmoens.com
