What is a citation? What does it mean?

A citation is a post-judgment action which means you currently have a judgment entered against you for something.

There are a few different types of citations. The first being the Citation to Discover Assets. This is served upon you and you must appear in court on the date listed on the citation. You are also required to bring any and all documents relating to your assets. So that means deeds to property, your bank account statements, your pay stubs, etc etc. On that date the plaintiffs attorney will sit down with you and review all the documents you have brought and question you under oath regarding your assets and ability to pay the debt.

The other type of citation is a 3rd Party Citation. This citation is served usually served upon financial institutions looking to see if you have bank accounts with that institution. If you have a bank account then that financial institution is required to freeze your account, notify the plaintiff's attorney and then the plaintiff's attorney will obtain a turnover order from the court. He will then send the turnover order to the financial institution and the institution will then send the funds in your account to be applied to the judgment.

You have certain rights when a citation is issued and those rights should be listed on the notice of citation which you should receive.
