Legal Question in Credit and Debt Law in Illinois

company credit card debt

I was issues a company credit for business use. For reasons too lengthy to list here (divorce, etc), I failed to use a reimbursement check to pay off the card. Now a collection agency is preparing to sue me. However, they are also trying to contact my boss about the debt, and are telling me that they intend to discuss the debt with my employer also name the company in the lawsuit.

My understanding is the debt is mine, and that I can/will be sued. However, do they have the right to discuss this debt with my employer, and/or to include my employer in the lawsuit? The collection agency is in Arizona, my employer in Missouri, and I reside in Illinois.

Yes, the simple answer is that the Creditor can contact, dun and even sue your employer if it was a company credit card. I would suggest that the Creditor (through the collection agency) may be willing to make arrangements for you to pay off the debt in installments rather than filing a lawsuit. Be sure to get everything in writing if you do succeed in making such arrangements.
