Legal Question in Credit and Debt Law in Illinois

I was contacted by a company that states that they are the legal department for Capitalone Credit Card. They said that they wanted to get a payment of at least 40% of the amount owed or I could pay $1550 of the $1600 owed to them or they will seek a lawsuit. I explained that I was going through financial trouble and a single parent, she did not care though she asked how this happened. The credit limit was only for $500 and the rest are fees. Can they actually take me to court for this or can I work out a lower payment option because they make it seem like these are my only to options before legal action take place?

They have to agree to a workout program. If they don't yes they can take you to court. A judgment against you will kill your credit rating if it isn't already in trouble. Time to seek out an attorney who can help you try to work these things out. If you are totally strapped there are legal aid foundations and the bar association in your county may be able to help you find an attorney who can work an arrangement with you for fees that won't make things even more difficult for you.
