Legal Question in Credit and Debt Law in Illinois

credit card debt

My credit card debt went to a law firm. They have had it for 4 mos. Since then I have paid $200, $100, $100 and $50. I owe $1500.00. I want to set up a payment plan but they keep threatening to call my husbans work and have his wages garnished. What are my rights? Thank you

Re: credit card debt

If their first correspondence to you did not say, "This is an effort to collect a debt and any information obtained will be used for that purpose" and if they did not give you 30 days to dispute the debt, the lawfirm owes you money. They can only garnish wages if they sue you and win. If your husband is not on the credit card, they cannot garnish his wages. They can only contact his work to obtain location information. If you advise them that you cannot receive telephone calls at work, they are prohibited from contacting you there. Google "Fair Debt Collection Practices Act" for more information.
